By accessing or using Wind Tunnel by TACITUS ("the Service"), operated by TACITUS.me ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Wind Tunnel is an experimental polarization intelligence platform that provides computational simulations of how ideas, policies, products, and campaigns may be perceived across different population segments. The Service uses the CiviSphere behavioral model to generate directional, probabilistic outputs.

3. No Predictive Warranty

All simulation outputs are directional and probabilistic. They are generated by computational models and are not predictive. You acknowledge that:

Results should not be the sole basis for business, legal, political, or policy decisions.
The CiviSphere behavioral model is a simplified abstraction of a complex population.
Tribe classifications and macro-categories are behavioral abstractions, not descriptions of actual named groups.
Model accuracy, calibration, and coverage may vary and will evolve over time.

4. User Obligations

You agree to:

Use the Service only for lawful purposes and in compliance with all applicable laws.
Not use the Service to discriminate against, harm, or target any individual or group.
Not reverse-engineer, decompile, or attempt to extract the source code or model weights.
Not use automated systems to scrape, crawl, or excessively load the Service.
Not misrepresent simulation outputs as certified predictions or authoritative assessments.

5. Intellectual Property

All content, software, models, data, and methodologies associated with the Service are the intellectual property of TACITUS.me or its licensors. The CiviSphere methodology and Conflict Grammar framework are proprietary. You retain ownership of any input data you provide to the Service.

6. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Notify us immediately of any unauthorized use.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TACITUS.ME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Your use of or inability to use the Service;
Any decisions made based on simulation outputs;
Unauthorized access to or alteration of your data;
Any third-party conduct on the Service.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless TACITUS.me, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective upon posting. Continued use of the Service after changes constitutes acceptance of the revised Terms.
